UNITEDMASTERS COPYRIGHT POLICY

Effective Date: January 31, 2023

UnitedMasters believes that all artists and creators should own and control their intellectual property. In compliance with the Digital Millennium Copyright Act, 17 U.S.C. 512 (the “DMCA“), UnitedMasters will respond expeditiously to remove or disable access to material that is claimed to infringe copyrighted material. In addition, UnitedMasters’ Terms of Service prohibit distribution of infringing materials, and UnitedMasters will reject or remove materials that it knows to be infringing.

Notification of Claimed Infringement

If you are a copyright owner or authorized to act on behalf of the owner of an exclusive right under copyright that is allegedly infringed, please notify UnitedMasters by completing a written notification of claimed infringement (the “Notification“). Note that the contents of the Notification will be forwarded to the alleged infringer and that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages.


To provide an effective Notification, you may complete this DMCA notification form, or send a written communication provided to UnitedMasters’ Copyright Agent that includes substantially all the following:


  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works, a list of such works, for example, the artist name, track, ISRC number, and time-stamps.

  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, AND information reasonably sufficient to permit UnitedMasters to locate the material, for example, the artist name, track, ISRC number, and time stamps.

  3. Information reasonably sufficient to permit UnitedMasters to contact you, including your full name, your organization’s name (if applicable), full mailing address, email address, and telephone number.

  4. The following statements:

    I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and

    The information in the Notification is accurate, and under penalty of perjury, that I am the copyright owner or authorized to act on behalf of the owner of an exclusive right under copyright that is allegedly infringed.


  5. A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the owner of an exclusive right under the copyright that is allegedly infringed.


Upon receipt of a valid Notification, UnitedMasters will forward the Notification to the alleged infringer and remove or disable access to the allegedly infringing material.


Counter-Notification

If a notification of claimed infringement has been submitted against your content, and you believe that the notification was sent due to a mistake or misidentification, please submit a counter-notification. Note that the contents of the Counter-Notification will be forwarded to the claimant, and that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material was removed or disabled by mistake or misidentification may be liable for damages. 


To provide an effective Counter-Notification, you may complete this DMCA counter-notification form, or send a written communication provided to UnitedMasters’ Copyright Agent that includes substantially all the following:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it disabled, e.g. artist name, track, ISRC number, original release date.

  2. Your full name, your organization’s name (if applicable), full mailing address, and telephone number.

  3. The following statements:

    I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, the judicial district in which UnitedMasters may be found, and will accept service of process from the claimant; and

    I swear, under penalty of perjury, that I have a good faith belief that the material identified in the notification was identified, removed, and/or disabled as a result of mistake or misidentification.


  4. Your physical or electronic signature.

Upon receipt of a valid Counter-Notification, UnitedMasters will forward the Counter-Notification to the claimant and may reinstate the remove material if it is able, unless UnitedMasters receives notification that the claimant has filed an action in court seeking to restrain you from engaging in infringing activity with respect to the materials. 

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, the Company terminates the accounts of users who are deemed repeat infringers under our policies. We may also limit access to our Services or terminate the accounts of users that infringe the intellectual property of others, in the Company’s sole discretion, whether or not they are repeat infringers.
